These Service Terms (the âTermsâ) explain the conditions that apply when you access or use the Website AfroQuant and the AI-assisted trading platform, together known as the âServiceâ, made available by AfroQuant Ltd. (âAfroQuantâ, âweâ, âusâ or âourâ). By entering or using the Service, you acknowledge that you have read and agreed to these Terms. If you disagree, do not access or use the Service.
1. Eligibility to use the Service
You must be at least 18 years old to access the Service. By using it, you confirm that you satisfy this age condition and have the legal capacity to accept these Terms. Do not use the Service where applicable law prevents you from doing so.
2. Account creation
Full access depends on an account with complete, accurate and up-to-date information. Protect your sign-in details and accept responsibility for activity carried out through your account. If you suspect unauthorised access, notify us promptly at [email protected] if you think another person has accessed the account without your permission.
We may suspend or terminate accounts that violate these Terms, contain deceptive information or are associated with fraudulent or abusive behaviour.
3. Service availability and limitations
AfroQuant provides AI-assisted market analysis, trading signals and, where available, automated submission of orders through connected broker accounts. The Service is intended solely for information and analysis.
- AfroQuant does not take custody of, hold or manage your money. Your funds stay in your brokerage or exchange account.
- We connect to your broker using API keys limited to viewing information and performing actions. Those credentials cannot be used to withdraw money.
- Past performance of a strategy or signal is not a reliable indication of how it may perform in the future.
- Trading carries significant risk, including the possibility of losing the capital you commit.
4. No investment guidance
Material made available through the platform AfroQuant does not constitute financial, investment, trading or any other professional advice. AI-produced content and research are general information only. You should consider consulting a suitably qualified financial adviser before deciding to invest. AfroQuant is not registered or authorised to provide investment advice, brokerage services or financial planning.
5. Charges and payments
Some Service features are available only with a paid subscription. Prices are shown on the pricing page and may be amended with 30 daysâ notice. Applicable taxes are not included and remain your responsibility. Subscriptions are billed in advance on a monthly or yearly basis. At our discretion, a new subscriber may qualify for a refund within 14 days of the initial charge.
6. Permitted use
You agree not to:
- Use the Service unlawfully or in breach of any applicable legal obligation.
- Reverse-engineer, decompile or disassemble the platform, or try to obtain its source code.
- Use automated tools to scrape, crawl or gather information from the Service.
- Resell, sublicense or commercially exploit any part of the Service without our prior written consent.
- Interfere with the Service or undermine its security, performance, integrity or supporting systems.
- Participate in market manipulation, front-running or other behaviour inconsistent with financial regulation.
7. Intellectual property rights
All content, software, algorithms, trade marks and confidential know-how provided with or through the Service belong exclusively to AfroQuant or its licensors. Nothing in these Terms transfers ownership or grants additional rights in that material. You must obtain written consent before using our trade marks or logos.
8. Warranty exclusions
THE SERVICE IS PROVIDED âAS ISâ AND âAS AVAILABLEâ, WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. AfroQuant WE DO NOT GUARANTEE THAT THE SERVICE WILL REMAIN AVAILABLE, RUN ERROR-FREE, OR BE CLEAR OF VIRUSES OR OTHER DAMAGING ELEMENTS.
9. Liability limitations
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AfroQuant WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY LOSS, INCLUDING LOST PROFITS, DATA LOSS, TRADING LOSSES OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAD BEEN WARNED THAT SUCH LOSS WAS POSSIBLE. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO AfroQuant IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10. Your indemnification obligations
You agree to indemnify, defend and hold harmless AfroQuant and its directors, officers, employees and agents from claims, liabilities, losses, damages and costs, including reasonable legal expenses, arising out of your use of the Service, breach of these Terms or violation of another partyâs rights.
11. Termination of these Terms
You can close your account through the settings or by emailing [email protected]. We may suspend or terminate access immediately after a breach. Once access ends, your authorisation to use the Service ends too, and account information may be deleted in accordance with our Privacy Policy.
12. Applicable law and dispute resolution
These Terms are governed by the law of England and Wales, without applying its conflict-of-law rules. Disputes should first be submitted to binding arbitration in London under the rules of the Chartered Institute of Arbitrators. Consumers in the EU or UK may also bring proceedings before courts available in their country or place of residence.
13. Amendments to these Terms
We may update these Terms periodically. Where a change is material, we will give you at least 14 daysâ notice by email or through a notice on the Platform. Using the Service once the amended Terms are effective indicates your agreement to them.
